Terms of Service

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this age requirement, that you have the legal capacity to enter into these Terms, and that your use of the Service complies with all applicable laws and regulations.

2. Your Account

To access certain features of the Service (such as posting jobs, submitting agency listings, building a CV, or posting comments), you may need to create an account. You agree to:

• provide accurate, current, and complete information when creating your account;
• keep your password confidential and not share it with third parties;
• promptly update your account information if it changes;
• accept responsibility for all activities that occur under your account and notify us immediately of any unauthorized use.

3. User Content

"User Content" means any material you submit, post, or publish on the Service, including job postings, agency listings, CVs, comments, scripts, and any other text, images, or files. You retain ownership of your User Content. By submitting User Content, you represent and warrant that:

• you own or have the necessary rights to submit the User Content;
• the User Content does not infringe the intellectual property, privacy, or other rights of any third party;
• the User Content is accurate, lawful, and not misleading, defamatory, or otherwise objectionable;
• you have all consents, licenses, and permissions needed to disclose any personal data of third parties (e.g. applicants, employees) contained in the User Content.

You grant DevKarriere a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, use, display, reproduce, modify, adapt, publish, translate, and distribute your User Content for the purpose of operating and improving the Service. This license continues until you delete your User Content or your account.

We reserve the right to remove or disable access to any User Content that, in our sole discretion, violates these Terms or is otherwise harmful to the Service or its users.

4. Job Postings & Agency Listings

If you post a job or submit an agency listing, you agree to the following additional conditions:

• Listings must be for genuine, currently open positions or active agency services. Fake, fraudulent, or misleading listings are prohibited.
• Listings must not discriminate on the basis of race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, age, disability, or any other protected characteristic.
• Listings must not require applicants to pay any fee as a condition of applying or being hired.
• You are solely responsible for the accuracy of all information in your listings, including job title, description, salary, location, and contact details.
• Submitted agencies are listed immediately but marked as unverified until reviewed by an administrator. We may edit, hide, or remove listings at any time.

5. Prohibited Conduct

You agree not to:

• use the Service for any unlawful purpose or in violation of any applicable law;
• harass, abuse, threaten, or impersonate any other user or any third party, or collect their personal data without consent;
• upload or transmit viruses, malware, or any other malicious code, or attempt to gain unauthorized access to the Service, its systems, or other users' accounts;
• interfere with, disrupt, or overload the Service — including by using scrapers, bots, or automated tools, except as explicitly permitted by us;
• circumvent, disable, or otherwise interfere with the security, advertising, or rate-limiting features of the Service;
• reproduce, duplicate, copy, sell, or resell the Service or any portion of it without our prior written consent.

6. Advertising

The Service is supported by advertising, including ads served by Google AdSense and other third-party advertising networks. These advertisers may use cookies and similar technologies (such as the DoubleClick DART cookie) to serve ads based on your visits to this site and other websites.

7. Intellectual Property

The Service and its original content (excluding User Content), including the DevKarriere name, logo, design, text, graphics, and software, are the property of DevKarriere or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

DevKarriere®, the DevKarriere logo, and other trademarks displayed on the Service are trademarks of DevKarriere. All other trademarks are the property of their respective owners.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any User Content, job posting, or agency listing on the Service.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall DevKarriere, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, use, goodwill, or other intangible losses — arising out of or in connection with your access to or use of (or inability to access or use) the Service, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amounts you have paid to us in the past twelve (12) months, or (b) USD 50.

10. Indemnification

You agree to indemnify, defend, and hold harmless DevKarriere, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses — including reasonable attorneys' fees — arising out of or in connection with your User Content, your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms. You may stop using the Service and delete your account at any time. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will continue to apply.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Paris, France.

13. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. We encourage you to review this page periodically. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
